1. General
The following terms and conditions (henceforth: the Terms and Conditions”) are valid between you and MONO+n.a.v.y ] mono-navy.com is a part of J. JS LEE Ltd. (henceforth: MONO+n.a.v.y; may be referred to as “us” and “we”). We are a limited company registered in England with registered company number 07541684 and with our registered address at Unit A, 9C Queens Yard, White Post Lane, London, E9 5EN, United Kingdom. These Terms and Conditions apply to all use of and orders placed on www.momo-navy.com, and orders made by e-mail with MONO+n.a.v.y ‘s Customer Service team (henceforth together: the “Website”). Please note that MONO+n.a.v.y does not guarantee that all products presented on the Website are in stock or are available for purchase. MONO+n.a.v.y preserves its right to stop selling a product. Orders can only be placed by persons that are 18 years or older. MONO+n.a.v.y reserves the right to revise the Terms and Conditions at any time. The date of the latest update is found in the final section of the Terms and Conditions. Each purchase is subject to the Terms and Conditions in the version applicable at the date of submitting the order. Please inform yourself about the applying version of Terms and Conditions before submitting your order. Please note that the terms and conditions valid for your order is always the terms and conditions that you have read and accepted before you have placed your order and not a later version. You should keep a copy of these Terms and Conditions for future reference.
2. Language
The language of the Terms and Conditions is English.
3. Placing an order
Your purchase of any of the products offered on the Website (“Products”) is subject to these Terms and Conditions and by placing an order for any Product, you confirm that you have read these Terms and Conditions and agree to be bound by them. Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. Please note that Products in your shopping bag are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the Website to fail, your selection of Products may be lost. In such case, you will be required to re-enter your selection of Products to the shopping bag.
Pre-Orders
All items are available to ship unless it is a pre-order item. Customers will be placed on a priority waiting list for pre-order items. All pre-order items have an estimated ship date, which indicates the date that the item will ship out from the warehouse, but these items may arrive sooner or later than specified. The estimated shipping date is published online. MONO+navy is not liable for delays, cancellations or changes to pre-ordered items made during production.
Credit cards are charged at the time of the pre-order, subject to our usual fraud checks. If a pre-ordered item will not ship out by the estimated shipping date, the customer will be notified and, at the customer’s election, either refunded in full or provided with an updated estimated shipping date. If an order includes both available and pre-ordered items, at least two separate deliveries will be most likely made to the customer.
4. Order confirmation
After submitting your order, we will send you an order confirmation e-mail acknowledging your order and including your order number, details of the Product or Products you have ordered from us, your payment details and delivery details. Please note that the confirmation e-mail is an acknowledgement that we have received your order and is not an acceptance of the order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy the Product(s) ordered. All orders are subject to acceptance by us. We are not obliged to accept your order and may, at our discretion, decline to accept any order. You do, however, acknowledge that by clicking on the "Proceed to payment" button, you enter into an obligation to pay for the Product(s).
5. Acceptance and shipping confirmation
Please note that all orders placed by you are subject to acceptance by us. We may, at our discretion, choose not to accept your order for any reason whatsoever without any liability to you. Once the order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order and these Terms and Conditions. The contract between you and us concerning the Product(s) ordered (“Contract”) will only be formed when we send you the shipping confirmation email. After entering into the Contract, we will be under a legal duty to supply you with goods that conform with the Contract. Please note that the Contract will only relate to the Product(s) which have been confirmed in the shipping confirmation email. We will not be obliged to supply any other Product(s) which may have been part of your order until such Product(s) has been confirmed in a separate shipping confirmation email. Please note that MONO+n.a.v.y does not guarantee that all Products presented on the Website are in stock or are available for purchase at the time of your order. If a Product is unavailable, we will contact you shortly, by phone or by e-mail.
6. Product information
MONO+n.a.v.y’s goal is to describe the products at the Website as correctly as possible. However, please note that due to the colour settings of your computer, the colours of the products shown in the pictures on the Website can differ somewhat from their actual colours. MONO+n.a.v.y cannot be held responsible for any such discrepancy. Any information on the Website regarding sizing of Products is included as a guide only. If you are in any doubt as to the size of any Product you require, we recommend that you contact us before placing an order
7. Prices
The prices and delivery costs shown on the Website include VAT. The prices and delivery costs shown on the Website may vary from time to time, and MONO+n.a.v.y is not bound by the price until MONO+n.a.v.y has accepted the order by sending the shipping confirmation to you. The prices may also vary between the UK Website and the Korean Website. If you have placed an order and the price has changed before we have accepted your order (by sending you the shipping confirmation), we will notify you by e-mail about the price change and give you the option to place a new order with the new price or cancel the old order. If we are unable to contact you, your order will be cancelled. MONO+n.a.v.y always reserves the right to cancel any order before we accept the order. If we already have received payment for a cancelled order we will refund you the amount of the purchase. The refund is made using the same payment method you used at the purchase. Please also note that MONO+n.a.v.y may cancel the order even if it has been accepted by MONO+n.a.v.y under the condition that you realize or should have realized that the price information was incorrect. The delivery costs are shown in connection with the shipping methods at the checkout stage.
8. Personalised items
Personalised products through the printing of initials cannot be returned or refunded. Once the order has been sent by the customer and confirmed by MONO+n.a.v.y, the customer will be informed via an order confirmation email. Once the order is processed and accepted, the customer will receive a shipping confirmation email. Personalised items may be delivered in a time slot indicated on the site which may be longer than regular delivery slots. Because of the clearly personalized nature of personalised products and the fact that they are produced specifically for the customer, they cannot be returned, refunded or exchanged. Similar, the customer does not have the right to cancel the order.
9. Payments
The following payments are accepted – Credit cards and debit cards.
Payment can be made by the following credit cards: Visa, Mastercard and American Express Payments can also be made by the following debit cards: Visa and Maestro. (Maestro and Visa Electron: please check with your bank to make sure your credit card is valid for online purchases). The purchases made with Visa and Mastercard are verified by a secure code. Please note that the funds will be reserved once you place the order using a credit or a debit card, however, the amount will not be captured until we ship your order. We do our best to make the Website as secure as possible. All credit/debit card transactions on the Website are processed using Shopify-Bogus gateway, a secure online payment gateway that encrypts your card details in a secure host environment. Payment will be debited and cleared from your account once your order has been shipped. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorise payment for any reason. If the issuer of your payment card refuses to authorize payment to MONO+n.a.v.y, your order will be cancelled. Please note, your card issuer may charge you an online handling fee or processing fee. We are not responsible for any charges or penalties which may be imposed by the payment provider as a result of payment being processed in respect of your order.
Paypal: When selecting the PayPal option, you will be directed to the PayPal site to “Log In” and review the amount shown before clicking “Pay Now”. Once this transaction is complete, you will then return to the Website.
Gift Cards: When placing an order using a gift card as payment, the order can only be shipped to the same country as to where the gift card was issued. MONO+n.a.v.y are unable to change the currency of the gift card, and it is always country-specific. This means that a gift card purchased online on our UK Website can only be redeemed online in the UK. Gift cards purchased online cannot be used in-store, and gift cards purchased in-store cannot be used online. You can also purchase gift cards online. If you purchase a gift card online, please keep in mind that they can only be redeemed online and not in a physical store. Also, they can only be redeemed in the UK if they are purchased from the UK website. Gift cards are valid one year from the date when they were purchased.
10. Delivery
Your order will be fulfilled by the delivery date set out in the shipping confirmation email or, if no delivery date is specified, then within 30 days after the date of the Order Confirmation, unless there are exceptional circumstances. The delivery costs are shown in connection with the shipping methods at the checkout stage. Your order will be delivered by UPS to the shipping address you have indicated if your orders are dispatched from UK. For orders dispatched from South Korea, you will receive your order by Hanjin Express. Rest of the world will be by UPS International. Products comprised within the same order cannot be delivered to different addresses. All orders are fully traceable on the Website by logging in to My Account. Click “My Orders” and fill in the tracking number for updated information about your shipment. For orders you have chosen to collect in-store, tracking information will not be displayed – please wait for an email notification stating that your item is ready to be picked up.
Shipping methods
We offer different shipping methods to meet your needs as further specified when you check out. Your order will be delivered to the delivery address within the United Kingdom and South Korea you specify when placing your order. If your delivery address is geographically remote, for example, certain outlying islands or other isolated locations, it is possible that we may not be able to deliver there. If that is the case, we will notify you before we accept your order. We reserve the right not to deliver to any country that is prohibited by applicable export laws. Orders cannot be delivered to PO Box or similar addresses. Please also note that you must comply with all applicable laws and regulations of the country for which the Product(s) are destined. We will not be liable for any breach by you of any such laws.
11. Risk and ownership
The Product(s) ordered will be at your risk from the time of delivery [or collection (as the case may be).] Ownership of the Product(s) ordered will also pass to you on delivery [or collection (as the case may be), provided full payment of all sums due in respect of the Product(s), including any delivery charges, has been received.
12. Returns Policy
Returned Products must conform to our returns policy below.
You have a legal obligation to take reasonable care of the Products while they are in your possession, and you must return them in the same condition in which you receive them (except to the extent reasonably necessary to examine them). This includes the following guidelines:
-Products should be returned unworn (other than to try them on), unwashed, undamaged and unused with their original tags and intact ‘do not remove’ tag;
-Life-style items and accessories should be returned in the original boxes or paper sacks provided;
-If the Product comes with a security tag this should be left on;
-Hosiery should only be returned if it is unopened and is in its original package; and
If you fail to comply with the above obligations (including the conditions of return), we may deduct from the refund an amount to reflect the diminished value of the Product(s) up to the full price of the Product(s).
You cannot cancel a contract for the supply of any of the following Products:
-Any Products that have been personalised or made to your own bespoke specifications unless such Products were damaged or faulty when delivered to you or have been incorrectly delivered (see Returns and refunds for customised Products below for more information);
-Any garments or cosmetics Products that have had a hygiene label or seal removed or broken.
Your returned item must arrive at the MONO+n.a.v.y warehouse no later than 14 days after the delivery date. We recommend that you book your return pick-up within 7 days of your delivery date to ensure that it arrives at the location within 14 days.
Exchanges
Purchased products are exchangeable into a different size and colour following the terms outlined in this Section 11. All exchanges are based on stock availability. If you have exchanged a product, MONO+n.a.v.y will pay the shipping costs for the new product. Please note that sale products are non-exchangeable but can be returned for a full refund.
Shipping costs for reconsigning the products
Please note that you must pay the shipping cost for returning the products following your right of withdrawal and exchange and MONO+n.a.v.y has no obligation to pay such costs.
Returns Process
Please contact us at info@mono-navy.com, giving your name, address and order number and specify items that you want to return for assistance with your return.
13. Defective products
If you receive defective products, please notify us immediately. According to the Civil Act, you are entitled to complain about defective products within one year. However, you must always notify MONO+n.a.v.y within a reasonable time after you have detected that the products are defective. If MONO+n.a.v.y consider the products to be defective, MONO+n.a.v.y will make a full refund including shipping costs.

Copyright in the documents provided in this site (including, without limitation, the trademarks of MONO+n.a.v.y graphics, text, photos, designs, logos, icons, images, data and software) are owned by or licensed to MONO+n.a.v.y and its affiliates. You are authorized to use this material only for personal, non-commercial purposes. You may download, print and store copies of this material for your own personal, non-commercial use, provided this Copyright Permission Notice is included in all such copies. You may not charge anyone for use of the material and you may not publish, duplicate or otherwise distribute the material to others without prior consent from MONO+n.a.v.y. You may not modify the material in any way, without the prior written permission of the copyright owner. Except as expressly stated in this legal notice, no rights or licenses to the material, or any portion thereof, shall be granted or implied.

15. Trademarks
MONO+n.a.v.y’s trademarks include but are not limited to the MONO+n.a.v.y name and logo, mononavy, mononavy life, Mono+n.a.v.y Retail and Mono+n.a.v.y Home. Please note that your use of this Website does not grant you any rights to use our trademarks.
16. Privacy policy

17. Security
SSL certificates are activated by default in Shopify for www.mono-navy.com check out, and for any content that’s hosted on www.mono-navy.com. MONO+n.a.v.y online shop secures communications by encrypting all data to and from the site. For security reasons, we do not store any payment information in our database.
18. Resale policy
You may purchase products on www.mono-navy.com for personal use only and not for resale. By placing an order on www.mono-navy.com, you certify that you are purchasing products for your own personal use and not for resale and that you accept the Terms and Conditions. We reserve the right to refuse orders for any reason without explanation.
19. Information on the website
MONO+n.a.v.y cannot promise that the content of the site is free of inaccuracies or typographical errors. Neither can we guarantee that all information is up-to-date. MONO+n.a.v.y may, at any time, amend the content of the site. Although MONO+n.a.v.y strives to display the correct texts, images and pricing on the site and online shop, errors may occur. Part of the services provided through the site are provided by third party operators. In situations where MONO+n.a.v.y acts as agent for such services, we cannot be held responsible for any errors resulting from their activities. MONO+n.a.v.y cannot be held responsible for any damage caused from using the site or, for that matter, not being able to use the site. MONO+n.a.v.y cannot guarantee problem-free, uninterrupted, and secure access to the site.

The Website may contain links to other websites beyond our reach. We assume no liability for content or privacy practices of such sites.
21. Violation of rules
MONO+n.a.v.y reserves the right to seek all solutions available to us against violations of these Terms and Conditions, including the right to block access to the site.
22. Liability
Nothing in these Terms and Conditions shall limit or exclude our liability to you:
-for death or personal injury caused by our negligence;
-for fraudulent misrepresentation;
-for breach of any term implied by the Consumer Rights Act 2015 and which, by law, may not be limited or excluded;
-under Part I of the Consumer Protection Act 1987; or
-for any other liability that, by law, may not be limited or excluded
-Subject to this, if you are a consumer and not a business customer, in no event shall we be liable to you for any business losses, and if you are a business customer, in no event shall we be liable to you for any indirect or consequential losses, or any loss of profit, revenue, contracts, data, goodwill or other similar losses, and any liability we do have for losses you suffer arising from any Contract shall not exceed the purchase price of the relevant Product(s) and is strictly limited to reasonably foreseeable losses. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us. Subject to the above, we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under any Contract that is caused by events outside our reasonable control, including war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events.
23. Provisions severability
If any part of these Terms and Conditions is held to be invalid or unenforceable, such determination shall not invalidate any other provision of these Terms and Conditions; instead, the invalid terms and conditions shall be replaced with other terms to give effect to the commercial intentions of these Terms and Conditions.
24. General
You may not transfer or assign any or all of your rights or obligations under any Contract. All notices given by you to us must be given in writing to the address set out at the end of these terms. We may give notice to you at either the email or postal address you provide to us when placing an order. If we fail to enforce any of our rights, that does not result in a waiver of that right. These terms may not be varied except with our express written consent. These terms and any document expressly referred to in them represent the entire agreement between you and us concerning the subject matter of any Contract. We are required by law to advise you that Contracts may be concluded in the English language only and that no public filing requirements apply. The European Online Dispute Resolution platform provides information about alternative dispute resolution which may be of interest.
25. Governing law
These Terms and Conditions shall be governed by English law, except that[(if you are a consumer and not a business user) and if you live in Scotland or Northern Ireland, there may be certain mandatory applicable laws of your country which apply for your benefit and protection in addition to or instead of certain provisions of English law. You agree that any dispute between you and us regarding these Terms and Conditions or any Contract will only be dealt with by the English courts, except that (if you are a consumer and not a business user) and if you live in Scotland or Northern Ireland, you can choose to bring legal proceedings either in your country or in England, but if we bring legal proceedings, we may only do so in your country.
